Subject: Seatbelts in classic vehicles

Thank you for your enquiry into the laws regarding the use of child restraints in historic or classic cars. In South Australia the following applies:

If a vehicle has no seatbelts fitted and is not registered as an historic vehicle then children under 7 years of age are unable to travel in the vehicle.

However, an exemption does apply if the child is travelling in an historic vehicle that has a conditional registration and is driven in accordance with the conditions of registration (as defined in Schedule 1 of the Motor Vehicles Act). If there are two or more rows of seats, children must not sit in the front row.

As you are probably aware, historic vehicles are only eligible for conditional registration if they are owned by financial members of a recognised motor vehicle club and are driven on a limited number of journeys each year.
